August 14, 2008-----MEETING WITH MR. CERCONNE

Initial meeting with Warren Cerconne to discuss what we needed to do about getting a skate park in Dormont.  I was told to get a design to present to council.

Contacted Wally Holiday in California cost was $10,000.00  How to get a design with no money?
and How do you get a design without knowing where it will be put?

Fundraising began to get money to pay for a design to present to Borough of Dormont as instructed.

Gathered a mock design and information on skate parks to present to Borough after realizing that
a skate park design could not be drawn without knowing where it would be put, so I had to approach the Borough Council


Oct 27, 2008- First meeting with Dormont Council
       
         On October 27, 2008, I, Mary Pitcher "pitched the Park" at the Dormont Council Session. It feels as though it should have been done a long time ago, but actually, it has been less than a month and a half since the idea really was set into motion.  Since September we have raised almost $10,000.00 and although that is just the start...it was an important start for further grant applications.  Public support from businesses, skaters, youth, adults and parents are a big part of proving that you deserve grants.  Also, this initial fundraising was to be used to develop a protype design to present to the Boro Council, however we are very fortunate to not have to use a "California"  designer.

       Although like most of you..... I would like to have the park built yesterday, in taking our time and through research being done (and we still have plenty of work to do on that!) , we have found
a possible, qualified designer right here in Pittsburgh, Pashek Designers, on the North Side that may assist us along with PTI where Vince graduated from the CAD Department! (My goal is to try and keep the involvement close to home!)  This desinger has built 3 County skateparks and designs were submitted to the Tony Hawk Foundation and they will consider him as qualified now that they have built three thriving parks!  Fortunately for us, in visiting these parks doing research
we have some new friends from the surrounding areas as well, who are skaters who will tell us what they like and dislike  or want made differently in our park.....to make it unique....to make ours better!

         I must admit, I was nervous at first presenting this to the Council, but I realize that with the support I've received from everyone who has touched this project and our family throughout the years, I should just tell them how I feel, tell them what I found out and let them decide if they feel this park would enhance our community.  The feeling I got from talking to all the park Managers was that it certainly drew attention to their parks, enhanced businesses in the areas and drew people from litterally the tri state community.  I also pointed out that there are only 53 parks like this in Pennsylvania!  A design such as this is really unique and the community, the park, the businesses and the people could all benefit greatly!

          All I can tell you is I did my humble best on behalf of my sons, my family and our communityy.  I presented a lengthy packet with information about skateboarding, the local parks and their designs and the "Wally Holiday" designers information.

         It seems that it was received well.  The Dormont Borough Council is setting us up with a meeting with the recreation board.....that is the next step.  If it isn't possible there, then we will have alternative places to build.

APRIL 2009- CONTACTED BY DORMONT COUNCIL TO GET DESIGN TO PRESENT

Laurie Malka called and said to go ahead and get design for skate park.

Contacted John Buerkle of Pashek and Associates who designed Boyce, South Park, and Finley who is a local designer (my thoughts were to stay local and use someone who knows the area and has sucess building quality parks)  I contacted the Tony Hawk Foundation and sent them his designs from those parks and they approved him as a designer.

Told by John Buerkle that we needed a site to come up with a proper design to present to Council. The design initial cost would be $5,000.00


May 2009- GINO RIZZA, LAURIE MALKA AND JOHN BUERKLE VIEW POSSIBLE SITES
Beggs Snyder, Dormont Park....best spot chosen by them, Memorial Drive old tennis courts.
Designer contracted and paid $5,000.00 for design to present to Borough.

May 2009- Design started by Pashek and Associates.
Openly discussed at public meeting with Council that design should be started and present it to Council when made available.

July 3 and 4, 2009 DESIGN COMPLETED
and presented to Pitcher Park on July 3, 2009
July 4- Design presented to the public at Dormont Day and was received 99.9 percent positively by the general public. We repeatedly told people that the design was not final and that it was a proposed location and drawing.  Only four out of the the thousands who saw it voiced a concern about the location of it.

July 27, 2009 - PROPOSED SKATE PARK PRESENTED TO DORMONT COUNCIL AT PUBLIC MEETING
About 125 Pitcher Park supporters were in attendance to hear the presentation. Approximately 9 Memorial Drive residents spoke in opposition. 7 said not opposed to skate park but the location was problem.  Showed Council petition of 125 names in opposition but never submitted that night to council. Pitcher Park was not there to voice opinion but to see the design proposal, however four people got up and spoke.  We had advised the skate park supporters to remain calm if opposition spoke and they did.
Mr. Maggio, Council President,  he stated that Pitcher Park had to go in front of the Planning Commission again and at the end of the meeting he made a public statement that "the skate park would not fit" which was quoted in the Tribune Review.

AUGUST 3, 2009- ATTENDED COUNCIL MEETING
Wanted to set up a meeting with Memorial Drive people as the complaints about the skate park being across the streets from their homes was heard and thought we could come to an agreement together.  Spoke at the meeting in regard to having a meeting with the Memorial Dr people, however was told "that would not work" and "that would make it worse".  I then asked if the  Council would schedule a vote on the skate park. Mr. Maggio told us we had to go to the Planning Commission and that he had told me that before. Then I was told to pass the microphone to a man standing behind me before I was finished speaking. I said "Am I done?"  and again said "Am I done?" From the Council bench I was told "Yes". I said "I guess I am?" and got up and left the meeting after being treated that way. 
I never heard that a motion was made or passed to vote on the Skate Park in September. I left the meeting IMMEDIATELY!

AUGUST 10, 2009- PLANNING PROPERTY AND SUPPLY MEETING
Pitcher Park people were finally allowed to be heard. While a woman who is a youth Minster was speaking, Mr. Eugene Barilla, Councilman, said "How long are you going to let these sons of Bitches talk?"  He was told to be quiet by Council members, Mr. Lehman and Mrs. Lusardi.  Jonathan Pitcher stood up and voiced his opinion of the "circus" unfolding in front of him and left.  He came back to the meeting only to hear the Memorial Drive people call his mother "that woman" repeatedly.   During that meeting however, Mrs. Pitcher spoke about moving the skate park down and twisting it away from their homes.  Some Memorial Dr residents stated "If you could do that, I feel your opposition would go away".  After hearing both sides and the room calming down, we left feeling as though something was accomplished at that meeting.
Mr. Maggio was not in attendance.
NOTE: We were never apologized to by Mr. Barilla publicaly.

AUGUST 11, 2009- CALLED JOHN BUERKLE
to redesign the park down further. He had to go to the park and see what area would be feasible to build on twisting the park down and away from the Memorial Drive residents.
NOTE:
Mr. Maggio, Council President, called John Buerkle, the designer that Pitcher Park
contracted and paid itself, $5,000.00 for the design and asked if the design would be ready by the 9th of September because they were going to vote on it with or without it. He told him just to bring what he had.

AUGUST 31, 2009- Agenda Meeting- PITCHER PARK/RALLY

100's of people attended carrying signs and spoke in favor of Pitcher Park. Channel 2 and Channel 11 were there filming.  A list of over 40 registered speakers were sent in ahead of time to the Borough. 
Mary Pitcher got up and asked if Dormont Council was going to allow all people to speak who wanted to speak and for how long they would be allowed to speak. Council President said "ONLY RESIDENTS AND 3 MINUTES".  Mary Pitcher asked "Can you show me in the Dormont Borough Rules and Procedures where it states that only residents can speak and for only 3 minutes."  We were given no answer and books were flying and pages were flipping.  Mary Pitcher asked again "Can you show me in the Dormont Councils Rules and Procedures where speakers must be residents and only get 3 minutes."  Mary Pitcher stated that they were in violation of the Sun Shine Act of PA and the
First Amendment of the Consitution of the US "Freedom of Speech if they refused to allow people the right to speak, if it was not in their "Rules and Procedures"   The Solicitor of Dormont, Deron Gabriel, then recited case law (which to date is unknown exactly what the case law was) about the Sun Shine Act and told us that the PA State rules supersede the Dormont Borough.   Mary Pitcher agreed with Mr. Gabriel that the Sun Shine Act of PA does supersede the Dormont Borough laws and she recited the Purdens site where this PA rule could be found and also that siting case law was not appropriate other than in a court of law.   Mary Pitcher actually turned to the crowd and told them that the Council was in violation of our rights and asked them  "If they wanted to walk out or stay and talk". The
supporters chose to stay and talk.
At that meeting over 35 people got up from 80 years old to 6 years old showing support for Pitcher Park.  Two or three of the opposition spoke.  We mentioned to Council that we had 800 names on a petition, which was started after the opposition started a website:  Save Dormont Park.com and a petition.


SEPTEMBER 19, 2009 - Deron Gabriel, Solicitor of Dormont called Called New Sun Rising (Pitcher Park's 501(c)3 Non-Profit sponsor for the Music Festival & hopeful sponsor for the rest of our skate park project.)

SEPTEMBER 20, 21, 2009 - New Sun Rising returned call from Deron Gabriel
After phone call, several Emails received by New Sun Rising from Deron Gabriel (personal email address and Law office email address) ... several pictures of the signs in window, literature about 501(c)3's and......
The last email said ......The signs must be removed from the window and the Facebook posting must be removed IMMEDIATELY.


SEPTEMBER 23, 2009- SECOND Presentation OF DESIGNS 2 AND 3
To a packed room John Buerkle of Pashek and associates gave a wonderful presentation of the third design and new site for the skate park.  Banksville Road seemed to be the answer to all the oppositions concerns.  No green space being taken up (actually it gave more green space to the Borough), the noise and lights were no problem (taken away from the residents and along the already busy Banksville Rd traffic), parking not a problem (because of the parking lot), the skate park would actually draw people to the pool and increase revenue  and  a full size basketball court and a half basketball court (to use while you are waiting to play) would be added to the complex next to the horse shoe courts to make it a place for all ages.
Under the Planning, Property and Supply meeting...EVERYONE WAS ALLOWED TO SPEAK. It was good to hear all sides.

It was brought out at this meeting that Pitcher Park had at this time 1100 signatures and 34 business owners in favor of a skate park in Dormont.

SEPTEMBER 28, 2009
Petition was turned in to John Mggio by Mary Pitcher. It contained 1, 165 signatures of Dormont Residents and 34 Business letters in favor of the skate park.


MARY PITCHER ADDRESSED THE COUNCIL ABOUT UNDERHANDED "THINGS" GOING ON BEHIND THE SCENES WITH PITCHER PARK.
1. She asked if anyone on Council was aware that someone appointed to Council called Pitcher Park's Non Profit sponsor. No one on Council acknowledged that they were aware of that.
She went on to tell them that Deron Gabriel called the 501(c)3
Non-profit trying to get her in trouble with them because of signs in a window.
2.  She also stated that the web site developer of SaveDormontPark.com Jeremy Smith, sent a letter to her attorney stating that someone had presented him with Police Records of her dead sons to put on the website. He stated he thought that was "over the top". ( They were not felons or criminals in any way shape or form!)  Mrs Pitcher thought that was UNBELIEVABLE that someone would even think of doing that!  The initial letter to Mr. Jeremy Smith, was sent by Pitcher Park because of the "accusations"  made on their website about "premature" collection of funds and other statements made on their website. 
3.  She also stated that there were several anonymous Web Site submission forms through PitcherPark.com stating that she was doing this only to get attention among other things.

President of Council, John Maggio, immediately read a prepared apology stating in part that "mistakes were made on both sides" and we would like to know WHAT ARE THOSE MISTAKES he publically said WE MADE?  He went on to say in part that if " a father of a soldier came to council to put in a gun club (what?)
or an obstacle course....... it would be handled differently.

Laurie Malka reported that the Finance & Legal Committee would be investigating the matter of the Solicitor further and someone yelled out from the crowd "Will the public be made aware of the out come?"

The Pittsburgh Post Gazette writer was in attendance and reported on Mary Pitcher's remarks with regard to the Solicitor calling the 501(c)3 and reported the matter would be investigated further.
NOTE:
The Solicitor, Deron Gabriel, at
approximately 8:00pm directly after the meeting, yet again called  New Sun Rising  to inform them that Mrs. Pitcher brought up accusations about him at  a public meeting before  Council.

OCTOBER 5, 2009- VOTING MEETING RE: SKATEPARK

The vote was 2 in favor and 5 against.

October 28, 2009 Dormont Council Agenda Meeting

1. A speech was made by a man involved with the Hollywood Theater from the state of Indiana.
Although he had a lot of nice things to say about Dormont and their plans about getting the 40,000 college students to come to the theater and to utilize the space in the theater , etc. .......
he was not on the agenda and although he was not a resident of Dormont, he spoke for 10 minutes without being interrupted other than when I pointed the video camera at him as he spoke and he stated he did not want to be video taped and said "I should ask for permission" and President Maggio agreed.  (FYI-   No one speaking at a public meeting has the right to ask not to be video taped nor does the President of Council have the right to stop anyone from video taping anyone speaking at a public meeting.)

FYI- The Hollywood Theater is associated with Hollywood Partners LLC and Motion Picture Heritage Corporation and is a Non-profit.

 
2.  I asked about the "Investigation into the Solicitor, Deron Gabriel and his actions toward Pitcher Park and our 501c3 New Sun Rising when he called, sent several emails with the last demanding that "the signs be taken out of the window and the facebook post be taken off immediately" 

Mr. Maggio simply stated "There was no investigation"  I said, "that is not what was stated at the previous council meeting" He stated that "There must be a misunderstanding. There is NO investigation."

3.  I then went on to say I had it from a good source that Mr. Maggio yourself was involved in the Solicitor calling the 501c3  He stated:  You should only listen to half of what you hear.  (Personally, Im not sure which half he is reffering to???)

4.  I told him I never knew that he was the President of a 501c3 himself "Friends of Dormont Pool" and he as a member of Council is promoting the pool and other 501c3 such as the Hollywood Theater at several council meetings and he laughed. 

5.  I then brought to the attention of Council that Mr. Barilla's remarks at the "Meet the Candidates" night were completely unfounded re the severe skate park problems in Peters Twp. I reported to them that I called Michelle of the Parks and Recreation Department and she confirmed that they had NO SEVERE PROBLEMS IN FACT...they built their skatepark shortly after a young boy was injured and is permanently paralyzed after getting hit by a car on the streets.  She also informed me that the only opposition to the skatepark from their council was liablitly.  That issue was cleared up when the Federal Act of Sovereign Immunity was brought to light as it gives all municipalities immunity of law suits with regard to recreational facilities unless there is negligence.  She told me to ask the Solicitor to look into that.

FYI- Mr Maggio was trying to stop Mr. Barilla (a fellow councilman) from talking.  I said in his defense "He has a right to speak!"  
 
PITCHER PARK HAS FELT THE NEED TO VIDEO TAPE EVERY MEETING WE ATTEND AND EVEN HAVE VOLUNTEERS TO TAPE THOSE WE DON'T.
